In these Terms, “Nova Uni,” “we,” “us” and “our” refer to Nova Uni UG i.G..
2. SCOPE
These Terms govern the purchase and use of the courses, videos, lessons, quizzes, exercises, certificates, educational materials and other digital content offered through www.nova-uni.com.
These Terms apply to customers located in the United States.
The description, price, access period, language, technical requirements and any specific conditions displayed on the relevant product page or during checkout form part of the contract.
If a specific product condition conflicts with these general Terms, the specific condition displayed during checkout will apply to that product.
3. PURCHASES FOR CHILDREN
The educational content offered by Nova Uni may be intended for children and teenagers.
The purchase and contractual registration must be completed by an adult who has legal authority to enter into the contract.
Where the person using the course is under 18, the purchaser represents and warrants that the purchaser:
a) is the child’s parent or legal guardian; or
b) has the legal authority necessary to purchase the service and permit the child to use it.
The adult purchaser is responsible for supervising the child’s use of the platform and for providing any parental permissions required by applicable law.
Children under 13 may not independently create an account or provide personal information through the platform.
Where information relating to a child under 13 is required, the account must be created or authorized by the child’s parent or legal guardian in accordance with our Children’s Privacy Notice.
4. DESCRIPTION OF THE DIGITAL CONTENT
Nova Uni provides online access to educational digital content that may include:
a) videos and lessons;
b) quizzes and assessments;
c) interactive exercises;
d) downloadable educational materials;
e) learning-progress tracking;
f) certificates or completion records;
g) other functions described on the relevant product page.
The essential characteristics, language, content, price, access period and applicable technical requirements will be displayed before the customer completes the purchase.
Unless the product page states otherwise, access to the purchased content is provided for two semesters beginning on the date access is activated.
The purchase does not provide permanent or unlimited access unless permanent or unlimited access is expressly stated in the product description.
5. ORDER PROCESS AND CONTRACT FORMATION
The display of a product on www.nova-uni.com is an invitation to place an order and does not itself constitute a binding offer.
The customer selects the product, enters the requested information and has an opportunity to review and correct the order before payment.
By clicking the button indicating that the order requires payment, the customer submits an offer to purchase the selected product.
The contract is formed when Nova Uni:
a) sends an order confirmation by email; or
b) activates access to the purchased content,
whichever occurs first.
The customer will receive an electronic confirmation containing the essential details of the purchase.
6. PRICES, TAXES AND PAYMENT
All prices are displayed in the currency indicated during checkout.
The final price, applicable sales tax and total amount payable will be displayed before the customer submits the order.
Sales tax may be calculated according to the customer’s billing or service location and the applicable state and local tax rules.
Payment must be made using one of the payment methods offered during checkout.
Nova Uni may use third-party payment processors. Those providers may process payment information according to their own terms and privacy notices.
Access may be withheld until payment has been successfully authorized or received.
7. DIGITAL ACCESS
The customer receives access after successful payment and completion of any required account or parental-verification process.
Creating an account or receiving an order-confirmation email does not, by itself, constitute use of the protected course content.
Protected course content is considered accessed when the user first:
a) opens or begins a lesson;
b) streams or plays a course video;
c) downloads educational materials;
d) begins an exercise, quiz or assessment; or
e) enters a protected course area containing the purchased content.
The date and time of first access may be recorded for security, service-delivery and refund-administration purposes.
8. VOLUNTARY CANCELLATION AND REFUND POLICY
United States law does not generally provide a universal 14-day cancellation right for online digital-content purchases.
Nevertheless, Nova Uni voluntarily permits a customer to cancel the purchase and request a refund within 14 calendar days after the contract is formed, provided that:
a) the user has not accessed any protected course content;
b) no lesson, video, exercise, quiz or assessment has been started;
c) no course material has been downloaded; and
d) the refund request is submitted to support@nova-uni.com within the 14-day period.
Once protected course content has been accessed, the purchase is non-refundable for a change of mind, except where otherwise required by applicable law.
This voluntary refund policy does not limit any legal rights the customer may have where the content:
a) was materially misrepresented;
b) was not delivered;
c) is materially defective;
d) cannot be accessed because of a failure attributable to Nova Uni; or
e) otherwise gives rise to a mandatory remedy under applicable law.
Approved refunds will ordinarily be issued to the original payment method.
9. USER ACCOUNTS
Where an account is required, the customer must provide complete and accurate information.
Login credentials must be kept confidential and may not be shared except as expressly permitted for a parent-managed child account.
The customer must notify support@nova-uni.com promptly if the customer believes that an account has been accessed without authorization.
The account and course access are personal and may not be sold, transferred or shared with unrelated third parties.
10. LICENSE TO USE THE CONTENT
The customer receives a limited, personal, non-exclusive, non-transferable and non-sublicensable license to use the purchased content during the applicable access period.
The customer does not acquire ownership of the digital content or any intellectual-property rights in it.
The customer may not:
a) sell, rent, sublicense or transfer access;
b) share login credentials with unauthorized persons;
c) copy, record, reproduce, publish or distribute the content;
d) make the content publicly available;
e) download materials unless downloading is expressly permitted;
f) circumvent technical protection or access controls;
g) use the content commercially;
h) publish assessment questions, answers or solutions;
i) modify the content or create derivative works without authorization;
j) use automated systems to extract, scrape or reproduce content.
All rights not expressly granted remain with Nova Uni UG i.G. or the applicable rights holder.
11. ACCEPTABLE USE
The platform may not be used:
a) unlawfully, fraudulently or abusively;
b) to infringe the rights of another person;
c) to introduce malicious software or harmful code;
d) to gain unauthorized access to accounts, systems or data;
e) to interfere with the security or operation of the platform;
f) to collect information about other users without authorization;
g) to impersonate another person;
h) in a manner that endangers or exploits a child.
Nova Uni may restrict or suspend access where there is a reasonable indication of fraud, misuse, a safety risk, a security incident or a material breach of these Terms.
12. TECHNICAL REQUIREMENTS
The customer is responsible for having:
a) a compatible device;
b) a reliable internet connection;
c) a current supported browser;
d) software capable of playing the content;
e) a valid email address.
Any material product-specific technical requirements will be displayed before purchase.
Nova Uni is not responsible for problems caused solely by an unsupported device, internet connection, software configuration or parental-control setting that does not satisfy the disclosed requirements.
13. PLATFORM AVAILABILITY
Nova Uni will use commercially reasonable efforts to keep the platform accessible during the applicable access period.
Temporary interruptions may occur because of:
a) scheduled maintenance;
b) software updates;
c) security measures;
d) failures affecting third-party providers;
e) circumstances outside our reasonable control.
Where reasonably possible, significant planned interruptions will be announced in advance.
If a prolonged failure attributable to Nova Uni materially prevents use of the purchased content, the customer should contact support@nova-uni.com.
14. CONTENT QUALITY AND CUSTOMER REMEDIES
Nova Uni will provide the purchased content substantially as described on the product page.
If the content is materially defective, materially different from its description or unavailable because of a failure attributable to Nova Uni, the customer should contact support@nova-uni.com with:
a) the order number;
b) the affected course;
c) a description of the problem;
d) relevant screenshots or technical details, where available.
Nova Uni may first attempt to correct the problem or restore access.
Where the issue cannot be corrected within a reasonable period, the customer may be entitled to an appropriate remedy, which may include replacement access, an extension of the access period, a partial refund or a full refund, depending on the circumstances and applicable law.
15. CERTIFICATES AND RESULTS
Where a course includes a certificate, it will be issued only if the user satisfies the requirements stated for that course.
Nova Uni may correct or revoke a certificate obtained through fraud, manipulation, unauthorized account use or an obvious administrative error.
Participation does not guarantee any particular academic, personal, professional, employment or financial result.
Unless expressly stated otherwise, certificates issued by Nova Uni are private course-completion records and are not government-accredited diplomas or degrees.
16. EDUCATIONAL INFORMATION DISCLAIMER
The content is provided for general educational purposes.
Unless expressly stated otherwise, the courses do not constitute individualized legal, medical, psychological, financial or professional advice.
Parents and users remain responsible for decisions made based on their individual circumstances.
17. THIRD-PARTY SERVICES
The platform may use or link to third-party services.
The customer’s direct use of a third-party service may also be governed by that provider’s terms and privacy notice.
Nova Uni is not responsible for third-party services outside its reasonable control, except to the extent required by applicable law.
18. LIABILITY
Nothing in these Terms excludes liability that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Nova Uni UG i.G. will not be liable for indirect, incidental, special, consequential or punitive damages arising from the use of the service.
To the maximum extent permitted by applicable law, the total liability of Nova Uni UG i.G. arising from a particular purchase will not exceed the amount paid for that purchase.
These limitations do not apply where prohibited by applicable law, including where liability results from fraud, intentional misconduct, gross negligence or another category of liability that cannot legally be limited.
Some states do not permit certain exclusions or limitations. In those states, the applicable limitation applies only to the maximum extent permitted by law.
19. PRIVACY AND CHILDREN’S PRIVACY
Personal information is processed in accordance with the Privacy Policy and, where applicable, the Children’s Privacy Notice available through www.nova-uni.com.
The parent or legal guardian must complete any legally required parental-consent process before a child under 13 provides personal information or receives an individual account.
20. CHANGES TO THESE TERMS
The version applicable to the purchase is the version presented and accepted when the order is submitted.
Nova Uni may update these Terms for future purchases.
A material change affecting an existing purchase will not be applied retroactively where doing so would unlawfully reduce the customer’s contractual rights.
21. GOVERNING LAW
These Terms and the contract are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles.
This choice of law does not deprive a consumer of mandatory protections that apply under the laws of the consumer’s state of residence.
22. DISPUTES AND COMPLAINTS
Before commencing formal proceedings, the customer is encouraged to contact:

The customer should include, where available:
a) the customer’s name;
b) the order number;
c) the affected product;
d) a description of the issue;
e) the requested resolution.
No mandatory arbitration provision or class-action waiver applies unless separately and validly agreed in accordance with applicable law.
23. FINAL PROVISIONS
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective.
The invalid provision will apply only to the maximum extent legally enforceable.
Section headings are included for convenience and do not affect interpretation.
